These Terms of Service (referred to as "Terms") govern your use of the Claimkit website (claimkit.eu) and the services we provide. By accessing or using Claimkit, you agree to be bound by these Terms.
Service Description
Claimkit is an automated drafting tool designed to help consumers generate legally-worded PDF letters asserting their statutory warranty rights under EU Directive 2019/771. Our service provides a template for consumers seeking a 2-year minimum seller guarantee.
It is crucial to understand that Claimkit is not a law firm, does not provide legal advice, and does not establish a lawyer-client relationship. The information and documents generated by Claimkit are for informational purposes only and should not be considered a substitute for professional legal advice.
What You Get
Upon successful payment, you will receive one PDF letter, generated based on the information you provide, in your selected language. This letter is designed for a single warranty claim.
Price and Payment
The price for generating an initial warranty letter is €2.99. An escalation letter, if needed, costs €1.99. These are one-time payments, and Claimkit does not operate on a subscription model.
All payments are processed securely by Lemon Squeezy, our Merchant of Record. Lemon Squeezy is responsible for handling all payment transactions, including the automatic application of any applicable EU VAT.
Digital Withdrawal Right (Waiver)
By requesting our service, which involves the immediate digital delivery of the generated PDF letter, you expressly acknowledge and agree to waive your 14-day right of withdrawal from the contract, as per Article 16(m) of the EU Consumer Rights Directive 2011/83/EU. This waiver is a legal requirement for immediate provision of digital content that is not supplied on a tangible medium.
Refund Policy {#refund-policy}
Due to the nature of our service, which involves the immediate provision of digital content, no refunds will be issued once the PDF letter has been generated and delivered to you.
However, if you experience any technical issues with the generation or delivery of your letter, please contact us immediately at contact@claimkit.eu. We will work with you to resolve any such problems.

- Not Legal Advice: The letters generated by Claimkit are templates. They do not constitute legal advice, and we provide no guarantees regarding the outcome of your claim.
- User Responsibility: You are solely responsible for the accuracy and completeness of the information you input into Claimkit. We are not liable for any issues arising from inaccurate or incomplete information provided by you.
- No Guaranteed Outcome: While our templates are designed to assert your statutory rights, we cannot guarantee that your claim will be successful or that the retailer will comply.
Limitation of Liability
To the fullest extent permitted by law, Claimkit's liability for any claim arising out of or in connection with the use of our service is limited to the amount you paid for the specific service (€2.99 or €1.99). We will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.
Governing Law
These Terms and your use of Claimkit shall be governed by and construed in accordance with the laws of the Netherlands.
Dispute Resolution
In the event of a dispute, we encourage you to first contact us directly at contact@claimkit.eu to seek an amicable resolution. If a resolution cannot be reached, disputes may be submitted to the Dutch Consumer Complaints Board (Geschillencommissie) or the Netherlands Authority for Consumers and Markets (Autoriteit Consument & Markt - ACM) before resorting to court proceedings.
